1.1 These Terms and Conditions govern the sale of trailers, custom fit-outs, and related services by Champions Food Trailers ("the Company") to the Customer. 1.2 By placing an order, the Customer agrees to be bound by these terms. These terms apply to all orders, whether for standard imported units or bespoke, made-to-order customisations.
2.1 Made-to-Order Basis: All trailers sold by Champions Food Trailers are manufactured, imported, or customised to the specific requirements of the Customer. They are not standard off-the-shelf stock items. 2.2 Customisation:Any modifications, fit-outs, signwriting, or specific equipment installations requested by the Customer become part of the bespoke specification of the trailer.
3.1 Prices quoted are valid for 14 days from the date of quotation unless otherwise stated. 3.2 Deposit: A non-refundable deposit of [Insert % e.g., 30%] of the total contract value is required to secure the order and commence the procurement/manufacturing process. 3.3 Progress Payments: For large custom orders, progress payments may be required at specific stages (e.g., upon arrival of the chassis, upon completion of fit-out). 3.4 Balance: The remaining balance is due prior to the release or collection of the trailer. The Company reserves the right to withhold delivery until full payment is received. 3.5 Currency: All prices are quoted in British Pounds Sterling (£) unless agreed otherwise in writing.
4.1 Commencement of Work: Once the deposit is received, the Company will immediately begin sourcing components, scheduling production, or initiating the import process. 4.2 No Cancellation After Production Starts: Due to the bespoke nature of the goods:
Once production, customisation, or importation has commenced, the order cannot be cancelled.
The Customer acknowledges that the trailer is being built to their specific specifications and cannot be resold to another party without significant modification. 4.3 Cancellation Before Production: If the Customer wishes to cancel before any work has commenced (prior to the deposit being applied to sourcing/manufacturing), the deposit may be retained by the Company to cover administrative costs and lost opportunity, at the Company's sole discretion. 4.4 Refunds: No refunds will be issued for orders cancelled after production has started. The Customer remains liable for the full contract price.
5.1 Estimated Delivery: Any delivery dates or lead times provided are estimates only. Given that these units involve international importation and custom manufacturing, delays can occur due to factors beyond the Company's control (e.g., shipping delays, customs clearance, supply chain shortages). 5.2 Force Majeure: The Company shall not be liable for any delay or failure to perform its obligations under these terms if such delay or failure is caused by events beyond its reasonable control, including but not limited to acts of God, war, strikes, lockdowns, or changes in import/export regulations. 5.3 Notification: The Company will notify the Customer promptly of any anticipated delays.
6.1 Pre-Delivery Inspection: Customers are encouraged to inspect the trailer upon collection or prior to final payment. 6.2 Acceptance: Once the Customer takes delivery or signs the delivery note, the trailer is deemed accepted in good condition, subject to any latent defects not reasonably discoverable at the time of inspection. 6.3 Damage in Transit: Any damage occurring during transit from the port of entry to the Customer's location must be reported immediately to the carrier and the Company.
7.1 Manufacturer Warranty: The chassis and major mechanical components are covered by the manufacturer's warranty (typically 12 months), subject to the manufacturer's terms. 7.2 Workmanship Warranty: Champions Food Trailers warrants that all custom fit-outs, electrical installations, and joinery are free from defects in workmanship for a period of [Insert Period, e.g., 12 months] from the date of delivery. 7.3 Exclusions: The warranty does not cover:
Normal wear and tear.
Damage caused by misuse, negligence, or failure to maintain the trailer as per the user manual.
Modifications made by third parties after delivery.
Consumables (e.g., light bulbs, fuses). 7.4 Remedy: In the event of a valid warranty claim, the Company's sole obligation is to repair or replace the defective part at its discretion.
8.1 Risk: Risk in the trailer passes to the Customer upon collection or delivery. 8.2 Title: Ownership (title) of the trailer shall not pass to the Customer until the Company has received payment in full of all sums due. Until then, the trailer remains the property of Champions Food Trailers.
9.1 Design Approval: Customers must approve all artwork and signwriting designs in writing before production begins. 9.2 Liability: The Company is not liable for errors in the final signwriting if the error stems from incorrect information or artwork provided by the Customer. 9.3 Third-Party Rights: The Customer warrants that any logos, trademarks, or images supplied for signwriting do not infringe on the intellectual property rights of any third party.
10.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. 10.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these terms.
11.1 These terms constitute the entire agreement between the parties and supersede any prior agreements or understandings.
